Rent Jacuzzi - Terms and Conditions of Business
1. Introduction
1.1 Rent Jacuzzi offers an online service for hiring our Equipment ("the Service"). “Rent Jacuzzi” or “we/our/us” means Will Owen trading as Rent Jacuzzi located at 20 Trojan Centre , Wellingborough.
1.2 By using this Website and/or placing an Order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound these terms and conditions hereunder, do not use or access this Website. You must read and accept all of the terms and conditions contained
herein before you may use or access the Website in any way.
1.3 These terms and conditions constitute the entire terms and conditions upon which Rent Jacuzzi
provides the Website and upon which the Customer agrees to contract for the purchase of
Equipment except where specifically varied by written Agreement by Rent Jacuzzi on its Order
acknowledgement. They supersede any written or oral representations, statements, understandings
or Agreements
1.4 From time to time, it will be necessary to update the terms and conditions and you agree to be bound by the new terms and conditions after the implementation date for the revised terms and conditions.
Definitions In this Agreement:-
“Agreement” means these terms and conditions together with the Customer’s Order as confirmed in
Rent Jacuzzi’s Order Confirmation.
“Charges” means the price to hire the Equipment Ordered, as set out on the Website.
“Complaints Process” means all complaints must be sent to info@rentjacuzzi.co.uk.
“Customer Information” means the information required by Rent Jacuzzi to allow us to deliver
Services.
“Hire Services” means the hire services offered by Rent Jacuzzi as outlined in the Order
Confirmation.
"Information" means any and all material contained in this Website.
“Order” means the Customers instruction to Rent Jacuzzi to proceed and supply the Equipment.
“Order Confirmation” means the email acceptance sent by Rent Jacuzzi following receipt of the
Customer’s Order. Please note in certain circumstances to accommodate some Customers the Order
Confirmation shall be delivered by postal service.
“the Customer” and “User” or “You / Your” means the hirer, the person, persons, consumer or
individual identified by as contracting for the Service.
“the Equipment” means all equipment hired by Rent Jacuzzi, including Jacuzzis, Gazeboes and
Speakers.
“the Website” means the Rent Jacuzzi website operating under the domain name of
http://www.rentjacuzzi.co.uk.
“Working Day” means within the hours of 9.00am to 5.00pm, Monday to Friday only, not including
bank holidays;
2. Service provision
2.1 Rent Jacuzzi will provide an Order acknowledgement for all Orders placed but reserves the right to accept or reject any Order at its sole discretion.
2.2 Rent Jacuzzi will use all reasonable endeavours to provide the Service as described on the Website.
3. Basis of Use of the Website
3.1 The Customer agrees to the following:-
3.1.1 that you understand, acknowledge and accept the exclusion of liability and disclaimer
provisions contained hereafter;
3.1.2 that you will only view the Information on the Website for your own private purpose and will
not publish, reproduce, store or retransmit any of the information contained on the Website (“the
Information”) at any time;
3.1.3 that you shall not use the Information for any unlawful purpose or in any unlawful manner;
3.1.4 that you shall not use the Website or the Information in any manner which may constitute an
infringement of any third-party rights (including but not limited to rights of copyright, trademark or
confidentiality);
3.1.5 that you shall not run any tools on the Website that systematically retrieve web pages for
offline or online viewing; whether it be for personal, commercial, experimental, experimental,
educational or any other use;
3.1.6 that all intellectual property rights (including in without limitation copyright, trademarks and all
other rights) whatsoever in the Information and the Website shall remain vested with Rent Jacuzzi at
all times;
3.1.7 that you acknowledge that Rent Jacuzzi has no obligation to provide the Website or any
Information or to ensure that you are able to use, provide and/or access the Information, and the
Website;
3.1.8 that you will indemnify and keep indemnified Rent Jacuzzi against all claims, liabilities,
damages, costs and expenses including legal fees arising out of any misuse of the Information or the
Website or breach of your obligations under his Agreement.
4. Order Process
4.1 Rent Jacuzzi will take an enquiry over the telephone by calling 07913 102679. All Orders must be
placed via the Website.
4.2 No Agreement in respect of any Order shall exist between us and You until your Order has been
accepted by us by means of an Order Confirmation (whether or not funds have been deducted from your account). If we do not accept your offer and funds have already been deducted, these will be fully refunded.
4.3 Where an Order is placed orally or in the event of any dispute as to the Order, the Order Confirmation shall be deemed as the authoritative Order.
4.4 Any quotation issued by email or through the website, will be valid up to the point any price changes are relevant but no change will take place after the Service is purchased.
5. Customer Obligations
5.1 Orders made by you may be placed via the Order process set out above.
5.2 The Agreement will relate only to those Equipment which we have confirmed in the Order Confirmation. No Agreement in respect of any supply of Equipment shall exist between us and you until your Order has been accepted by us by means of an Order Confirmation (whether or not funds have been deducted from your account). If we do not accept your offer and funds have already been deducted, these will be fully refunded.
5.3 When placing an Order for the first time, you will be required to register with us through the Website via the Order process.
5.4 The Customer is responsible for providing a satisfactory level of cooperation and for providing all necessary Customer Information and facilities to enable Rent Jacuzzi to produce and deliver a quality service, including:
5.4.1 necessary Customer Information for delivery including name, home address, delivery
address, email address, landline and mobile telephones;
5.4.2 suitable access and facilities for delivery including;
5.4.2.1 We will need a clear path to the site where you want the Hot Tub set-up.
There should be a minimum of 70 cm with no obstructions to allow delivery.
5.4.2.2. The Customer must make available a clean level surface that can take the
weight of a Hot Tub filled with water. The set-up location needs to be within 7 meters
of a mains power source. The Hot Tub also needs to
be set up close to a water source. The size of the space needed for the Hot Tub is a
minimum of 2x2m. The size of space needed for a gazebo is a minimum 3x3m.
5.4.2.3. The Customer must ensure the grass areas be suitable, the ground is firm and
free from any potential punctures. The Customer understands that the grass may
discolour as a result of a Hot Tub positioned on the grass.
5.4.2.4 We are not responsible for any damage to Customers property including water
and weight damage.
5.4.3 adhere to the delivery process including;
5.4.3.1 to sign the proof of deliver on delivery.
5.4.3.2 to carry out checks on the Equipment when its delivered.
5.5 The Customer is fully responsible for the liability of the Equipment when delivering is completed.
5.6 The Customer is entirely responsible for obtaining and holding all consents, licences, permits and other similar instruments including planning permission to allow Rent Jacuzzi to deliver the Service.
5.7 The Customer agrees accept guidance from a Rent Jacuzzi’s representative when using the website or placing an order online.
5.8 The Customer agrees to allow Rent Jacuzzi to post or upload photos of the Equipment on the Website and Social media.
6. Third Party Websites
6.1 The Website contains links to websites operated by parties other than Rent Jacuzzi. Such links are provided for the User's convenience only. Rent Jacuzzi does not control such websites, and is not responsible for their content. Rent Jacuzzi’s inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators. The User is solely responsible for evaluating the accuracy and completeness of any information contained on the third-party websites, and also the value and integrity of any Equipment and services offered by such websites.
6.2 You may only link to this Website with Our express written permission. We expressly reserve the
right to withdraw our consent at any time to a link which in our sole opinion is inappropriate or
controversial.
7. Service Charges
7.1 Charges for the Service shall be based upon the Customer paying the full Payment for the Service
in advance of the Equipment being issued.
7.2 The prices charged shall be those stated on the Website and confirmed in the Order Confirmation provided to the Customer. Prices on the Website are inclusive of VAT. The delivery charges will be added to the total charge for the Service identified in the Order Confirmation.
7.3 Unless otherwise agreed, no Service will commence until payment has been received.
7.4 Rent Jacuzzi reserves the right to change prices or institute new charges for use of the Service at any time.
7.5 All payments must be cleared and received before any Equipment are dispatched.
7.6 Charges are based upon the Customer paying for the Equipment in advance.
7.7 The prices charged initially shall be those stated on the Rent Jacuzzi Website.
7.8 No Equipment will be dispatched until payment has been received.
7.9 Rent Jacuzzi will not be liable for any bank charges incurred by the Customer.
7.10 In the event the Equipment requires to be re-delivered, where applicable, the Customer accepts
they are liable for that cost.
7.11 The Customer shall not re-hire, sell, mortgage, charge, pledge, part with possession of or otherwise deal with the Equipment and shall protect against distress, execution or seizure and shall indemnify the Company against all damages, losses, costs, charges and expenses that may be
occasioned by failure to observe and perform this condition except in the case of government requisition.
7.12 The Customer shall not assign his rights hereunder nor sub-let or lend the Equipment or any parts thereof to a third party without the prior express consent of the Company.
7.13 The Equipment shall be used at the location where the Equipment is delivered to by Rent Jacuzzi.
8. Payment of Service Charges
8.1 The Agreement is based upon the Customer paying in full the initial payment in advance of our acceptance of the Customer’s Order, prior to the Service commencing through our Bacs or through the third- party payment providers via the Website.
8.2 You confirm that the credit/debit card that is being used is yours. All credit/debit cardholders are
subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not accept your Order and we will not be liable for any delay or non-delivery and we are not obliged to inform You of the reason for the refusal. We are not responsible for your card issuer or bank charging You as a result of our processing of your credit/debit card payment
in accordance with your Order Confirmation.
8.3 The Customer shall not be entitled by reason of any set-off, counter-claim, abatement, or other deduction to withhold payment of any amount due to Rent Jacuzzi.
8.4 All Equipment on hire shall at all times remain the absolute property of Rent Jacuzzi and no proprietary or other interest in the said Equipment shall vest in or pass to the Customer who shall for all purposes be deemed the Bailee of the said Equipment.
9. Proprietary Rights
9.1 All Intellectual Property Rights in the materials on this Website (as well as the organisation and
layout of this Website) are owned by, licensed or authorised to Rent Jacuzzi Ltd, its assignees,
licensees or sub-licensees thereof and the copyright in the text, artwork, graphics and images on the
Website is owned by Rent Jacuzzi or its licensors or its content or technology providers except where
otherwise specified. Nothing in these terms and conditions transfers to you any rights of ownership
of such intellectual property rights, or constitutes a license to use such intellectual property rights
other than to the extent expressly set out in these terms and conditions. Without Our prior written
permission, you may not copy, modify, alter, publish, broadcast, distribute, sell or transfer any
material on this Website or the underlying software code whether in whole or in part. However, the
contents of this Website may be downloaded, printed or copied for your personal non-commercial
use.
10. Changes
10.1 Should the Customer require a change in the nature, scope or timing of the Service or in any
other aspect of this Agreement, such change shall be requested in writing. Rent Jacuzzi shall advise
the Customer of the effects including any increase in the Service charges which may result and the
Agreement shall be modified to reflect such changes including to the Service charge and/or
duration which may be agreed.
11. Refunds and Inspection
11.1 We do not offer refunds except in the case of Rent Jacuzzi being at fault resulting in delivery of an incorrect Equipment or the Equipment delivered in a faulty condition.
11.2 Rent Jacuzzi shall not be liable in respect of any claim unless the aforementioned requirements have been complied with except in any particular case where the Customer proves (i) it was not possible to comply with the requirements and (ii) advice (where required) was given and the claim made as soon as possible.
11.3 Subject to Clause 11, at the point of collection, Rent Jacuzzi will conduct a quality inspection and test of the Equipment. In the event the Equipment is damaged, faulty or not in working condition, the Customer will be liable for replacing the Equipment or provided with a full refund if the Equipment is found to be faulty.
12. Disclaimer and Limitation of Liability
12.1 In no event will we be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of access to, or the use of this Website or any information contained in it, including loss of profit and the like whether or not in the
contemplation of the parties, whether based on breach of contract, tort (including negligence),Equipment liability or otherwise, even if advised of the possibility of such damages.
12.2 To the maximum extent permitted by law, we disclaim all implied warranties with regard to the information, services and materials contained on this Website. All such information, services and materials are provided “as is” and “as available” without warranty of any kind.
12.3 The Customer must make every effort to secure their username, passwords and key phrase details and should not under any circumstance disclose their username and password and key phrase details to a third party or by an email request. Rent Jacuzzi, nor its directors, employees or
representatives will be liable for damages arising out of or in-connection with the use of this Website or information, content, materials or Equipment included on this Website. This is a comprehensive limitation of liability that applies to all damages of any kind.
12.4 It is the Customers responsibility to maintain and update browser, firewall or anti-virus and antispyware software. The Customer must protect their Computer and ensure they update all security software by downloading the latest security patches from relevant software provider.
12.5 Rent Jacuzzi will endeavour to provide services as described on the Website but cannot guarantee 100% uptime.
12.6 The Customer shall pay the Company the full replacement value of hired Equipment not returned
or the full cost of repairing any damage together with any additional hire charge calculated in accordance with these Conditions due to loss or damage.
12.7 Equipment returned late will be charged all Charges for every day late, this includes Equipment not ready for collection that will be charged for, including any additional expenses incurred by Us.
12.8 The Customer shall indemnify and hold harmless the Company against all loss and damage to the Equipment during the rental period and the appraisal for any such loss or damage shall be based upon the replacement cost of the Equipment without deduction or depreciation together with any additional hire charge calculated in accordance with this Agreement.
12.9 The Customer shall be liable for all resulting loss or damage to the Equipment and expense of the Company to the extent that it: a) results from the gross negligence of the hirer which included, but is not limited to, the use or operation of the Equipment in a reckless or abusive manner or, intentional damage to the Equipment by the hirer or by the hirer’s permission or, b) occurs under either of the
following circumstances: i) All loss or damage associated with vandalism, malicious mischief, theft or conversion of the Equipment; and/or ii) All loss or damage associated with Equipment being overloaded, operated above rated capacity or if operating instructions are not followed.
12.10 The Customer uses the Service at its own risk and in no event shall Rent Jacuzzi be liable to the Customer for any direct, consequential, incidental or special damage or loss of any kind (except personal injury or death resulting from Rent Jacuzzi negligence) including but not limited to, Customer
missing deadlines, loss of or corruption of data or the Customer 's inability to use the Service, however caused and whether arising under contract or tort, including negligence or otherwise except as expressly provided herein.
12.11 Rent Jacuzzi shall not be under any liability if it is unable to carry out any of the services for any reason beyond its control including (without limiting the foregoing): force majeure, act of God, acts of terrorism, pandemic flu, legislation, war, fire, flood, drought, failure of power supply, unexpected illness, lock-out, strike or any other action taken by the Customers representatives in contemplation or
furtherance of dispute.
12.12 Rent Jacuzzi is not responsible for any services purchased by the Customer other than those Services provided by Rent Jacuzzi.
12.13 Rent Jacuzzi is not responsible for third-party mistakes or external delays and will not accept delay in payment to us from you as a result of such circumstances.
12.14 Rent Jacuzzi will have no liability in respect of any delays, deficiencies or interruptions in the supply of the Service caused by a failure by the Customer to comply with any provision of this Agreement.
Customers use of the Equipment
12.15 Except as expressly provided in this Agreement, no warranty, condition, undertaking or term, expressed or implied, statutory or otherwise, as to the condition, quality, performance, durability or fitness for purpose of the Equipment is given or assumed by us and all such warranties, conditions, undertakings and terms are hereby excluded insofar as permitted by law.
12.16 WE SHALL NOT IN ANY CASE BE LIABLE TO YOU OR TO ANY OTHER PARTY FOR DIRECT, SPECIAL,
INCIDENTAL, CONSEQUENTIAL INDIRECT OR SIMILAR LOSS OR DAMAGES (INCLUDING ALL MANNER
OF COSTS, FEES AND EXPENSES) ARISING FROM BREACH OF WARRANTY, BREACH OF CONTRACT,
NEGLIGENCE OR ANY OTHER CAUSE.
12.17 If any exclusion, disclaimer or other provision contained in this Agreement is held to be invalid
for any reason by a court of competent jurisdiction and Rent Jacuzzi becomes liable thereby for loss or damage that may lawfully be limited, such liability whether in contract, tort (including negligence but specifically excluding personal injury or death resulting from Rent Jacuzzi’s negligence) or
otherwise, will not exceed the value of the Order.
12.18 Rent Jacuzzi cannot be responsible for damage to any Customer property due to the Customer mis-use of the Equipment, issues with using or inability to follow the Equipment care instructions.
12.19 The Customer is solely responsible for assessing the suitability of the Equipment and the correct size of the Equipment prior to purchasing the Service
12.20 During the Customers use of the Equipment or following delivery of the Equipment, should the Equipment suffer damage, the incident is not the responsibility of Rent Jacuzzi. The Customer should treat the damage as an insurance issue.
12.21 Rent Jacuzzi cannot be held responsible for any Equipment being out of stock.
12.22 Rent Jacuzzi is not responsible for any other Equipment, or any related Equipment purchased by the Customer.
12.23 The Customer agrees to NOT TOUCH the Equipment during setting up process“ as the portable gas boiler is hot and under no circumstances is to be touched. The Customer agrees to keep all persons all from the gas boiler at all times.
12.24 Where applicable, We will install the gazebo on delivery but only if the weather is suitable (i.e.no or very little wind). The gazebo is not a permanent structure and can be damaged easily in some weather conditions, especially wind. It is the hirer’s responsibility to look after the gazebo and if required to take it down to avoid damage should the weather conditions change to make it unsuitable for gazebo use. If the gazebo is damaged beyond repair, the replacement cost and the Customer will be liable and payment due to Rent Jacuzzi.
13. Treatment of Equipment (instruction and maintenance)
13.1 All Rent Jacuzzi’s Equipment should only be treated as outlined in these care instructions and as stated in this Agreement. In no circumstances, should heat should be applied directly to the Equipment and the Equipment should be stored in a dry location. It is critical you the Customer, clean the Equipment with a non-abrasive material, and use the recommended soapy water or use (nonchemical) cleaning fluid to maintain the Equipment. The Equipment should always be cleaned and dried after use.
Connection to Mains Services and Electrical Equipment
13.2 Connection and disconnection to mains services on site are the responsibility of the Customer and must be performed by a competent operative. The Customer also grants Rent Jacuzzi permission to use of power/utilities to deliver the Service.
13.3 The Customer must make available a clean level surface, within seven (7) meters of a mains power source and close to a water source.
13.4 Any electrical Equipment should be used with plugs and/or sockets as fitted.
13.5 The Customer shall be responsible at all times to arrange a proper supply of electricity for use with the Equipment and ensure that the Equipment shall at all times be properly earthed. Damage to Equipment from incorrectly connected or disrupted supply will be charged.
Instruction of use
13.6 The Customer agrees to follow the care instructions without deviation and is liable for all issues
related to using the Service outlined in this agreement including;
13.7 Please do not use the Hot Tub during pregnancy or suffering from tummy upset in the last 7 days. Or if you suffer from heart disease, diabetes, low or high blood pressure, or any medical condition, please consult a doctor before use. Also, anyone with skin, ear, genital or other body infections, open sores, or wounds should not use the Hot Tub because of the possibility of spreading
infection. Hot tubs are not suitable for children under the age of five and older children (all children under 16 years of age) must not be allowed to use the Hot Tub without an adult being present.
13.8 Only children tall enough to stand with their feet on the floor and their head out of the water should be allowed to use the Hot Tub. Under 16’s should ALWAYS be supervised. The Customer is responsible for all persons who use the Equipment including;
13.8.1We recommend the Customer never uses the Service while consuming narcotics/other drugs/excessive alcohol.
13.8.2 Please Do Not Immerse your head in the Hot Tub water.
13.8.3 When not in use, make sure the cover is on in order to eliminate the risks for children and pets. At ALL times make sure pets are a safe distance away from the Hot Tub.
13.8.4 Please do not use the Hot Tub immediately after a meal. Avoid entering the Hot Tub water immediately after exercising as the water temperature can affect the heart rate.
13.8.5 Please do not use glass when entering the hot tub.
13.8.6 Do not use the Hot Tub if you have recently had a spray tan as you may block the filter and discolour the hot tub.
13.8.7 Do not use any electrical appliances near/in the Hot Tub. This is a MAJOR risk.
13.8.8. If any allergic reaction occurs, please leave the Hot Tub and rinse off in the shower. If the reaction persists contact your local GP or seek medical help.
13.8.9 Please ensure no contaminants i.e. - bubble bath, alcohol, oils etc are placed in the water as this may upset the chemical balance of the water and can result in allergic reactions.
13.8.10 Please DO NOT smoke in OR near the Hot Tub – this could cause damage.
13.8.11 Do not allow chlorine to come into contact with your skin and do not ingest or inhale the water.
Using the chemicals
13.9 It is the responsibility of the Customer to maintain the chemical balance of the Hot Tub water and to wash the filter after each use. It is vital to maintain the Hot Tub well to ensure it is kept clean.
Use of Chemicals and Cleaning Instructions includes;
13.9.1 The water should be tested at least twice a day once in the morning before use and once in the evening after use. Testing the water is very easy. Take one of the test strips from the foil and dip it in the water and remove immediately. Hold the test strip level for 15 seconds; do not shake water from it. Now hold the strip against the colour chart on the pot and observe the colouring.
13.9.2 If chemicals are to be added to the Hot Tub it should not be used for at least 30 Minutes after chemicals have been added. Please check if the water is at safe levels before use.
13.9.3 The ideal reading for PH level is 7.2. If the colour-chart shows it as being above (7.8 or higher) then PH REDUCER (PH-) needs to be added. This is easily done by filling the small pot with PH reducer (PH-) up to the 10ml level (about 2 teaspoons), add this to a bucket or container of warm water stirring as you add. Then add to the water in the Hot Tub.
13.9.4 If the PH level is low (6.8 or lower) then PH INCREASER (PH+) needs to be added This is easily done by filling the small pot with PH increaser (PH+) up to the 10ml level (about 2 teaspoons), add this to a bucket or container of warm water stirring as you add. Then add to the water in the Hot Tub.
13.9.5 The Chlorine level should be between 3 and 5. If the Level is higher, then do nothing as the levels will decrease. To speed up the decrease run the Hot Tub with the bubbles on and cover off. This will help reduce the level.
13.9.6 If the Chlorine level is low, then it really is a simple question of adding Chlorine to the hot tub. This is easily done by adding Chlorine. Add this to a bucket or container of warm water stirring as you add. Then add to the water in the Hot Tub. Please wait at least half an hour before using the Hot Tub.
14. Equipment Warranty
14.1 The Customer is responsible for ensuring that the Equipment are suitable for their intended purpose and no warranty condition or representation is given by the Rent Jacuzzi as to the fitness of the Equipment for any particular purpose unless otherwise expressly agreed. The Equipment are sold
on the express understanding that they are subject to issues outlined in this Agreement.
15. Force Majeure
15.1 Rent Jacuzzi shall not be liable to you or be deemed to be in breach of the Agreement by reason of delay in performing, or any failure to perform, any of our obligations in relation to the Service, if the delay or failure was beyond our reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond our reasonable control:
15.1.1 act of god, explosion, flood, tempest, fire or accident; weather, war or threat of war, sabotage, pandemic flu or virus, insurrection, civil disturbance or requisition; acts, restrictions, regulations, byelaws, prohibitions or measures or any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions, power cuts or trade disputes (whether involving our employees or of a third party);
15.1.2 technical problems, external circumstances preventing suppliers delivering against deadlines or preventing delivery of third party against agreed commitments including delivery services.
16. Cancellation
16.1 If you are purchasing as a consumer, you may cancel your Order with us, at any time up to the seventh working day (7) before the Service is delivered as stated on the Order Confirmation. Subject to clause 16.2 and 16.3 you do not need to give us any reason for cancelling your Order up to 7 days before delivery of the Service.
16.2 The following shall apply should the Customer cancel the contract: -
16.2.1 In the event of cancellation 7 full days or more before the beginning of hire, we will provide a full refund.
16.2.2 In the event of cancellation less than 7 full days before the beginning of hire the full Charges shall be due.
16.2.3 We will allow the Service to be moved to the new date subject to availability. Please note we will allow one (1) reschedule per hire.
16.3 To cancel your Order, please provide us with written notice by post to Rent Jacuzzi, address, or info@rentjacuzzi.co.uk in each case 7 days before the delivery date and giving details of the items Ordered, and (where appropriate) their delivery date.
16.4 If you have received the Equipment before you cancel your Order then you are liable for full hire and all charges associated with the hire.
16.5 Once you have notified us that you are cancelling your Order, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 7 days of your Order being cancelled, provided that the Equipment in question is returned by you and received by us in a reasonable condition.
17. Cancellation by Us
17.1 In addition to our rights under clause 17 above, we reserve the right to cancel the contract between us if: (i) we have insufficient stock to deliver the Equipment you have Ordered; (ii) we do not deliver to your area; or (iii) one or more of the Equipment you Ordered was listed at an incorrect price due to a typographical error or an error or change in the pricing information.
17.2 If we do cancel your Order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 7 days of your Order.
18. Delivery and Collection
18.1 Completed Orders will be sent to the delivery address that you have given on your Order form. We cannot be held responsible if that delivery address is incorrect or incomplete. Please note that we do not deliver to PO boxes.
18.2 Rent Jacuzzi’s times of delivery will be agreed with the Customer following our acceptance of the Order.
18.3 Rent Jacuzzi shall bear all risk in respect of consignments until delivered to the Customer. Once a Completed Order has been received by you (including collection for the Equipment by you), all risk of damage to, or loss of, the Equipment shall pass to you.
18.4 We only deliver to the Customer’s premises as outlined in section 5, which requires us to deliver on their private property or property which has granted permission to the Customer to allow delivery, we will deliver subject to the Customer indemnifying Rent Jacuzzi against all damages including failure to deliver which may result in a charge of £50 will be incurred for another delivery and/or pick up slot.
18.5 The Customer is responsible for informing Rent Jacuzzi as to the nature of the delivery address road surface. Some surfaces (uneven or sloping ground) is not suitable for a van or lorry or trailer. If the point of delivery is unsuitable for delivery by van or lorry and we are unable to make the delivery due to this, the Customer may be liable for additional delivery charges. If in the opinion of Rent
Jacuzzi (including the driver) the ground or access over which delivery or unloading is required is unsuitable for safe passage Rent Jacuzzi may refuse to deliver or deliver to the nearest accessible point.
18.6 Delivery dates are approximate only and not an essential term of the Agreement. Rent Jacuzzi shall have no liability in respect of delay in delivery to the Customer.
18.7 Notification of damage, delay or loss of Equipment in transit or of non-delivery must be given in writing to Rent Jacuzzi and the carrier within one clear day of delivery (or, in the case of nondelivery, within 7 days of notification of despatch of the Equipment) and any claim in respect thereof must be made in writing to Rent Jacuzzi and the carrier within one clear day of delivery (or in the
case of non-delivery, within 7 days of notification of despatch). All other claims must be made in writing to Rent Jacuzzi within one days of delivery. Rent Jacuzzi shall not be liable in respect of any claim unless the aforementioned requirements have been complied with except in any particular case where the customer proves (i) it was not possible to comply with the requirements and (ii)
advice (where required) was given and the claim made as soon as possible.
18.8 The Customer shall indemnify Rent Jacuzzi in respect of any claim for loss or damage arising from unloading of the Equipment.

20. Data Protection

21. General
21.1 Failure or delay by Rent Jacuzzi in enforcing any term of the Agreement shall not be construed as a waiver of any of its rights under it.
21.2 The illegality, invalidity or unenforceability of any part of this Agreement will not affect the legality, validity or enforceability of the remainder.
21.3 We shall be entitled to subcontract, assign or transfer our obligations or rights to a competent third party or to any associated company whether in whole or in part. The Customer may not assign or transfer any of your rights or obligations without our written consent.
21.4 The construction, validity and performance of this Agreement shall be governed by English Law.
